How to Get a Patent?

So, you have an idea or a design, which you think is really different and no one has ever had. It's time to move forward and look for a patent so that nobody can copy that idea.

But, we generally don't know what a patent is, the protection it gives, how much does it cost, how long does it last, should I hire a patent attorney and many questions related to this. In the article, we will discuss about patent and find out the answers to your questions.

The first step to get a patent is to define your unique idea onto a paper. Try to give as much details as possible, because you will receive a patent when you will include lots of details and avoid a vague or a too broad concept.

After doing this, go to the website for the patent made by government and look for “Online patent searches”. Here, you will find two options, one is “issued patents” and the other is “published applications”. Research on both the options, but your first step should be going through “issued patents”.

Use the advanced search option provided in to to find out all the terms that you can think of for relating the idea you want to patent. Focus on the option that reads “1976 to present”, because anything before that will not matter in most of the cases.

After this, search all the headline results and look for those similar to your patent idea. Click on the links that apply to you. Study the way they are formatted and find if your idea is exactly like the patent issued idea. If you have come to know that somebody else has already got a patent on your idea, then it will save your patent application fee.

If you don't find any idea similar to yours, then go back to the page that had two options of “issued patents” and “published applications” Now click on the second option, go to advanced search and again search for the ideas similar to yours. If there is an idea similar to yours, then remember that the patent will be granted to that idea. But, it does not mean that you can not apply for it. Just improve upon your idea and apply again. If the application of similar idea is turned down by authorities due to any reason, then you patent could still be issued.

In this step also, there is no idea similar to yours, then proceed further to apply for a patent. Go back to the page where you clicked n “online patent searches”, and click on “basic initial filing”. Fill all the details and choose the type of patent you are applying for. All the instructions are very simple, and you will easily file an application for the patent.
